Judicial support of the recognition of the agreement on the assignment of the claim invalid in the amount of more than 1 million UAH

In order to protect violated rights and interests in the dispute about collecting money in the amount of more than 1 000 000 UAH a natural person-entrepreneur appealed to Patriot.Legal.

During familiarization with the case materials it was established that in violation of the contract conditions under which the obligations arose, the creditor, without obtaining a client’s consent, assigned the right of claim to a third party. In addition, the new creditor violated the rules of jurisdiction of the dispute and did not apply to the Chamber of Commerce and Industry of Ukraine to settle the dispute, as agreed between the parties in the original contract, under which the monetary obligation arose.

Based on the conducted analysis the claim was filed to invalidate the agreement on assignment of right of claim, and in the existing dispute the claim was filed to suspend the proceedings until the court decision on the case to invalidate the agreement on assignment of the right of claim takes effect.
