Patriot.Legal represents a Ukrainian representative of a famous magazine and an Internet publication in a domain transfer dispute under the administrative procedure of the Uniform Domain Dispute Resolution Policy (UDRP) by the WIPO Arbitration and Mediation Center (WIPO Arbitration and Mediation Center) of the World Intellectual Property Organization (WIPO).
Our clients: Ukrainian representative of a famous magazine and an Internet publication, which filed a claim with the WIPO Arbitration and Mediation Center (WIPO Arbitration and Mediation Center) for the transfer of domains in the zone com.ua to the Owner of the relevant trademarks used in the domains, due to the unilateral termination of the License Agreement by the same trademark owner.
Executed work: To begin with, Patriot.Legal lawyers formed a legal position, containing the collected evidence regarding the fact that the License Agreement, illegally terminated unilaterally by the Trademark Owner is valid. Therefore, our Client legally registered the disputed domain names, as expressly provided for in the License Agreement. And now it continues to fulfill its obligations imposed on it by this License Agreement in good faith. The demands to transfer the domains are still unfounded. Therefore, as long as there is a dispute over the termination of the License Agreement between the Complainant and the Respondent, WIPO cannot consider the merits of this issue.
At this stage, we are exchanging procedural documents between the parties through the WIPO Arbitration and Mediation Center of the World Intellectual Property Organization (WIPO).
