Thus, a preliminary contract was concluded between the client and the supplier, under which the company was obligated to deliver and transfer the ownership of the vehicle.
Despite the fact that the client has fulfilled all monetary obligations, the supplier has not fulfilled its obligation. The company’s reference to the impossibility of fulfilling the obligation due to the imposition of martial law was counter-argumented by the violation of the procedure and procedure for notification of force majeure circumstances, as well as the availability of the company to fulfill its obligation.
According to the court’s decision, the currency in which the payment is made is the euro, which allowed the client to avoid foreign exchange losses.
